Terms and Conditions

1. Scope and identity of the Seller

These Terms and Conditions, hereinafter the “Terms”, apply to orders placed on the Memory Chest Co. online store by customers acting for private purposes, hereinafter the “Customer”.

They apply to deliveries offered in Switzerland, Liechtenstein and the countries of the European Union available at the time of ordering.

By placing an order, the Customer confirms that they have read and accepted these Terms in the version applicable at the time of the order.

The Shipping Policy, Return and Refund Policy, Privacy Policy and other policies published on the store supplement these Terms.

Any mandatory rights granted to the Customer under the law of their country of residence remain applicable and are not limited by these Terms.

2. Products and information

The essential characteristics, dimensions, compatibility, box contents and main conditions of use of each product are presented on its product page.

Before ordering, the Customer must check that the product is suitable for the formats, devices or media they intend to use.

Photographs, videos and lifestyle images are provided for illustrative purposes. Slight differences in color or appearance may result, in particular, from the screen used or normal manufacturing variations. These differences do not limit the Customer's rights where a received product does not correspond to the characteristics expressly advertised.

Offers are valid while stocks last. If an ordered product becomes unavailable, the Seller will inform the Customer as soon as reasonably possible and refund any amounts already paid for that product.

3. Prices, currencies, taxes and additional charges

Prices are displayed in the currency applicable to the selected market, including Swiss francs (CHF) for the Swiss market and euros (EUR) for European markets where that currency is offered.

The total price, shipping charges, taxes collected by the Seller and any other known charges are shown before final confirmation of the order.

As of the date of this version, the Seller is not registered in the Swiss VAT register. Swiss VAT is therefore not charged directly by the Seller for as long as this status remains applicable.

For international deliveries, import taxes, customs duties or customs-clearance charges may apply depending on:

  • the destination country;

  • the location from which the product is shipped;

  • the value and nature of the product;

  • the delivery terms disclosed at the time of ordering.

Where these amounts are collected by the Seller at checkout, they are shown in the order summary.

Where they are not included in the price paid on the store, they may be charged to the Customer by the authorities, carrier or customs-clearance provider. This possibility must be disclosed to the Customer before the order is confirmed.

The Customer is invited to contact the Seller at info@memorychestco.com if a carrier requests an amount that was not disclosed or appears to be incorrect.

4. Ordering and conclusion of the contract

The Customer selects the products, reviews the cart, provides the requested information, chooses the available delivery and payment options, and checks the order summary before confirming the order.

The Customer may correct their information until final confirmation of the order.

After the order is placed, an electronic acknowledgement is sent. The contract is concluded when the Seller confirms acceptance of the order or begins processing it, whichever occurs first.

The Customer must check the confirmation and promptly report any error concerning the products, address or order details.

The Seller may refuse or cancel an order for a legitimate reason, including in the event of:

  • product unavailability;

  • inability to deliver to the address provided;

  • an obvious error in the price or description;

  • declined or incomplete payment;

  • reasonable suspicion of fraud or misuse.

Any amount collected for an order refused or cancelled by the Seller will be refunded without undue delay.

5. Cancellation before processing

The Customer may request cancellation of an order without charge as long as it has not been processed for shipment.

The request must be sent as soon as possible to info@memorychestco.com, together with the order number.

Where cancellation is possible, it will be confirmed by email and any amounts collected will be refunded to the original payment method.

If the order has already been processed or shipped when the request is reviewed, cancellation may no longer be possible. The Customer may then exercise any return or withdrawal rights under Section 9 and the Return and Refund Policy.

6. Payment

Available payment methods are displayed at checkout.

Payment is processed by Shopify and/or the relevant provider for the selected payment method. The Seller does not necessarily receive all bank or card information used for the transaction.

The order may be suspended or cancelled if payment is declined, incomplete, cancelled or flagged as potentially fraudulent, subject to reasonable and proportionate verification.

The Customer confirms that they are authorized to use the selected payment method.

7. Delivery

Available destinations, shipping charges, indicative delivery times, any restrictions and tracking arrangements are set out in the Shipping Policy and, where they depend on the order, before the order is confirmed.

The Customer must provide a complete, accurate and accessible address. The Customer is responsible for checking their details before confirming the order and for notifying the Seller immediately of any error.

Additional costs actually incurred because of an incorrect or incomplete address, failure to collect a parcel or unjustified refusal of a parcel may be charged to the Customer to the extent permitted by applicable law.

Announced delivery dates are estimates unless expressly stated otherwise.

For orders intended for a consumer in the European Union, delivery will take place no later than thirty days after conclusion of the contract unless another period has been expressly agreed.

In the event of a significant delay, the Customer may ask the Seller to complete delivery within an additional reasonable period. If delivery still does not take place within that period, the Customer may terminate the contract under the conditions provided by applicable law.

The risk of accidental loss of or damage to the product passes to the Customer when the Customer takes physical possession of the parcel or when it is delivered to a person designated by the Customer.

This rule does not apply where the Customer independently chooses a carrier that was not offered by the Seller, to the extent permitted by applicable law.

8. Receipt and inspection of the order

The Customer is encouraged to inspect the parcel and products upon receipt.

Any damage, missing item, apparent defect, delivery error or non-conforming product should be reported as soon as reasonably possible to info@memorychestco.com, together with:

  • the order number;

  • a description of the issue;

  • photographs of the product, parcel and shipping label where useful.

Visible transport damage should also be reported to the carrier at delivery where possible.

Failure to report immediately does not deprive the Customer of any mandatory rights.

The Customer must retain the product, its accessories and its packaging until receiving the Seller's instructions.

9. Right of withdrawal and 14-day returns

9.1 Customers in the European Union and Liechtenstein

Subject to statutory exceptions, the Customer has 14 calendar days to withdraw from a distance purchase without giving a reason.

The period begins on the day after the Customer, or a person designated by the Customer other than the carrier, takes physical possession of the product.

Where several products from the same order are delivered separately, the period begins on the day after receipt of the last product concerned.

To exercise this right, the Customer must send a clear statement before expiry of the period to:

The Customer may use the form at the end of these Terms, but use of the form is not mandatory.

After notifying the Seller of the withdrawal, the Customer must return the product no later than 14 days afterwards, in accordance with the Seller's instructions.

The Customer bears the direct return costs unless:

  • the Seller has agreed to cover them;

  • the return results from a defect, damage, non-conformity or an error by the Seller;

  • applicable law requires the Seller to bear them.

The Seller refunds amounts received for the products concerned as well as the standard delivery charges for the order.

Any additional charges resulting from the Customer's choice of a more expensive delivery method than the standard method offered are not refunded.

The refund is made no later than 14 days after receipt of the withdrawal notice. The Seller may, however, defer the refund until the product is recovered or until the Customer provides proof of shipment, whichever occurs first.

The refund is made using the original payment method unless expressly agreed otherwise.

9.2 Customers residing in Switzerland

Swiss law does not provide a general automatic right of withdrawal for online purchases.

Memory Chest Co. nevertheless voluntarily grants customers residing in Switzerland a 14-calendar-day commercial return right, calculated in the same way as the period described above.

For a voluntary return due solely to a change of mind:

  • the direct return costs are borne by the Customer;

  • the original shipping charges are not refunded;

  • the product price is refunded after receipt and inspection of the product.

9.3 Conditions applicable to returned products

The product must be returned:

  • complete;

  • with its accessories, cables, holders and instructions;

  • with information allowing the order to be identified;

  • in its original packaging where reasonably possible;

  • properly protected for transport.

The Customer may inspect and handle the product to the extent necessary to establish its nature, characteristics and operation.

A reduction in value resulting from excessive use, damage attributable to the Customer or missing items may be deducted from the refund to the extent permitted by applicable law.

9.4 Exceptions

The right of withdrawal may in particular not apply:

  • to products made to the Customer's specifications or clearly personalized;

  • to sealed goods that are not suitable for return for health protection or hygiene reasons where their seal has been removed after delivery;

  • to digital content supplied without a tangible medium where performance has begun with the Customer's prior express consent and acknowledgement that the right of withdrawal is lost;

  • to other products or services lawfully excluded from the right of withdrawal.

An exception is applied only where it is actually applicable and the Customer has been informed before ordering.

These exceptions do not limit the Customer's rights where a product is defective, damaged, incomplete, non-conforming or sent in error.

10. Defects and statutory warranty

Rights relating to defects apply independently of the 14-day return or withdrawal right.

10.1 Switzerland

For new products sold to consumers in Switzerland, the limitation period for warranty claims for defects is two years from delivery, subject to applicable mandatory provisions.

Depending on the nature of the defect and the circumstances, the remedy may include repair, replacement, a price reduction or a refund.

10.2 European Union and Liechtenstein

Customers residing in the European Union or Liechtenstein benefit from the statutory conformity warranty provided by the mandatory law applicable in their country of residence.

This protection is at least two years in the European Union, without prejudice to longer periods or more favorable protections provided by national legislation.

Where the product is non-conforming, the Customer may request remedies available under applicable law, including:

  • repair;

  • replacement;

  • a proportionate price reduction;

  • termination of the sale and a refund where the statutory conditions are met.

Remedies are provided without cost to the Customer where applicable law so requires.

10.3 Exclusions

Damage resulting in particular from:

  • an accident;

  • use contrary to instructions;

  • unauthorized modification or repair;

  • improper storage;

  • insufficient maintenance;

  • normal wear and tear,

does not constitute a defect attributable to the Seller.

The Customer must allow the Seller to inspect the product and follow reasonable return instructions before a final remedy is implemented.

Applicable mandatory provisions remain reserved.

11. Defective, damaged, incomplete or incorrect products

Where a product is defective, damaged on delivery, incomplete, does not conform to the order or was sent in error, the Customer must contact info@memorychestco.com.

Depending on the circumstances, the Seller may offer a repair, replacement, shipment of a missing part, a price reduction or a refund.

Reasonable return shipping costs for a product confirmed to be defective, damaged, incomplete, non-conforming or sent in error are borne by the Seller in accordance with its instructions.

The Customer must not incur unusually high return costs without prior approval, except in an urgent situation or where the law provides otherwise.

12. Liability and data backups

The Seller is liable for damage attributable to it in accordance with applicable law.

No exclusion or limitation of liability applies in particular:

  • in the event of intentional misconduct or gross negligence;

  • in the event of injury to life or physical integrity;

  • with respect to product liability;

  • where an express guarantee has been given;

  • where a mandatory provision prohibits a limitation.

The Customer must retain the original media and make independent backups of their files.

The Customer should not delete, alter or dispose of an original until the integrity and quality of several digital copies have been verified.

Negatives, slides, memory cards, cables and devices must be handled in accordance with the manufacturer's instructions.

13. Events beyond our control

Neither party is liable for a delay directly caused by an unforeseeable event beyond its reasonable control, provided that it informs the other party and takes reasonable measures to limit the consequences.

This provision does not deprive the Customer of mandatory rights, including where delivery does not take place within the statutory or agreed period.

Obligations already due, including refunds owed, remain applicable.

14. Intellectual property

Content belonging to the store, including text, photographs, videos, logos, illustrations and graphic elements, is protected by applicable intellectual property laws.

Reproduction, modification, distribution or commercial use requires the prior authorization of the rights holder, except where an exception is provided by law.

15. Personal data and cookies

The processing of personal data relating to orders and use of the store is described in the Privacy Policy.

The use of cookies and similar technologies is explained in the cookie banner and cookie preferences available on the store.

16. Governing law and dispute resolution

These Terms are governed by Swiss law, excluding its conflict-of-law rules and, to the extent permitted, the United Nations Convention on Contracts for the International Sale of Goods.

This choice does not deprive a Customer residing in the European Union, Liechtenstein or another country of mandatory protections granted by the law of their country of residence.

Mandatory rules concerning court jurisdiction and consumer forums remain reserved.

Before initiating proceedings, the Customer is invited to contact the Seller at info@memorychestco.com in order to seek an amicable solution.

17. Languages and translations

These Terms may be made available in several languages.

Translations are provided to allow the Customer to understand the conditions applicable to their order.

In the event of a discrepancy between language versions, no translation may be interpreted in a way that deprives the Customer of mandatory rights available in the Customer's country of residence.

18. Final provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in force.

The affected provision will, to the extent permitted, be replaced by a valid rule that corresponds as closely as possible to its original purpose.

The version applicable to an order is the version accepted when the order was placed.

Any subsequent amendment applies only to future orders unless otherwise required by law.
